Our close relationships with our clients and their businesses, coupled with our broad litigation and transactional experience, allow us to efficiently analyze claims, so that we can advise our clients regarding a proper course of action.  We understand that alternative dispute resolution, including mediation, may be a cost-effective solution for our clients, and we regularly counsel our clients with respect to settlement in an attempt to avoid the costs and uncertainties of litigation.  If matters cannot be resolved voluntarily, our lawyers will litigate zealously, aggressively, and cost-effectively.

Financial Services Litigation

Since its founding, Henderson & Lyman has represented financial service clients in all forums, including enforcement proceedings brought by the Securities and Exchange Commission and the Commodity Futures Trading Commission; civil actions in federal and state courts; reparations proceedings before the Commodity Futures Trading Commission; and in arbitrations before the American Arbitration Association, the National Futures Association and the Financial Industry Regulatory Authority.  Our substantial experience in the financial services industry enables us to maximize efficiencies, given our in-depth understanding of our clients' unique business needs and the complexity of the markets and regulatory framework in which they operate.

Recent representative financial services litigation engagements include:

  • Serving as national litigation counsel in the Refco, LLC Chapter 11 proceedings.
  • Representing Futures Commission Merchants in connection with the ongoing Sentinel Chapter 11 proceedings.
  • Representing a national Broker-Dealer in an employment discrimination case pending in federal court.
  • Defending Introducing Brokers, Futures Commission Merchants, and Broker-Dealers in connection with customer complaints.
  • Representing all categories of financial services industry registrants in arbitration, litigation, and enforcement matters in a variety of forums.
  • Providing extensive counseling in connection with efforts to obtain the return of segregated funds in an ongoing international Commodity Pool receivership matter.

Business and Commercial Litigation

Henderson & Lyman has a robust business and commercial litigation practice, whose lawyers offer business-oriented solutions to clients.  We represent clients in a wide variety of commercial and business litigation matters.  In addition to its general commercial litigation practice, Henderson & Lyman represents clients in real estate disputes, employment disputes, and environmental disputes.

Representative business and commercial litigation engagements include:

  • Representing client in business dispute before the Illinois Supreme Court regarding statutory notice required before filing consumer fraud lawsuit.
  • Representing automobile dealer in a class action lawsuit alleging dealership failure to disclose material information prior to sale.
  • Representing clients in claims against former employees for breach of employment agreements, including breach of non-compete and non-solicitation provisions.
  • Representing business entities and individuals in a variety of complex contractual disputes.
