Practice Areas
Mr. Kay is a partner in Henderson & Lyman's Financial Services Practice Group. He concentrates his practice on counseling financial services entities in connection with a wide variety of compliance, regulatory and litigation matters. He represents commodity and derivatives industry clients, including Futures Commission Merchants, Forex Dealer Members, Introducing Brokers, Commodity Pool Operators, and Commodity Trading Advisors, in connection with regulatory matters before the National Futures Association and the Commodity Futures Trading Commission. He represents broker-dealers and Investment Advisers in connection with regulatory matters before the Financial Industry Regulatory Authority and the Securities and Exchange Commission. He regularly defends financial services industry clients in federal and state court litigation, as well as in FINRA and NFA arbitrations and CFTC reparations proceedings, all over the country. He also counsels financial industry clients in connection with a variety of consumer credit regulatory matters and related litigation.
Mr. Kay has written articles and given presentations on a wide variety of timely litigation and regulatory issues. He has served as an Adjunct Professor at the University of Richmond, and taught a class regarding the Sarbanes-Oxley Act to the staff of a national securities broker-dealer. He currently serves on the Board of Directors of a national consumer products company headquartered in Chicago. He also serves as an advisor to the Board of Directors of a publicly-traded financial services company.
